Important Update – Tribunal Payments and Pitch Fee Increase

SANDY BAY PARK RESIDENTS ASSOCIATION (Sandybayparkra@gmail.com) We would like to update residents who were involved in the tribunal regarding outstanding payments and the new pitch fee increase. 1. Outstanding payments following the tribunal Management have confirmed that they will not be sending out individual invoices. Instead, you will need to visit the office and ask how much you owe from last year's pitch fee. Management will confirm the amount outstanding, and once you have paid, you will be given a receipt. 2. New pitch fee increase Management have explained that the increase letters for tribunal residents are being dealt with by Head Office. Now that the tribunal outcome has been received, we understand that this matter can move forward. Our annual pitch fee review date is 1 November. Under the Mobile Homes Act 1983, Management must follow the statutory procedure when notifying residents of a proposed increase. Where the required notice has not been served within the statutory timescale, the late-notice provisions under Paragraph 17(6) of Schedule 1 apply. This means that the increase cannot simply be backdated to 1 November. If a resident agrees to a proposed increase following a late notice, it becomes payable from the 28th day after the notice is served. Please continue paying your existing pitch fee for now. Do not start paying the increased amount until you have received the appropriate notification and the correct effective date has been established. We will keep everyone informed as soon as we receive further information from Management. We appreciate your patience and understanding. Kind Regards SBPRA
